Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the Pouchd mobile application and website ("the App"), operated by Nicholas Morin ("we," "us," or "our") doing business as Pouchd. By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

Eligibility

Pouchd is intended exclusively for adults who are 21 years of age or older and who already use nicotine pouches. By using the App you represent and warrant that you are at least 21. We do not knowingly permit anyone under 21 to create an account, and we will terminate accounts we believe belong to minors. The App does not promote or encourage the use of nicotine products and is not intended for anyone seeking to begin using them.

Your Account

• You are responsible for the information you provide and for keeping it accurate
• You are responsible for maintaining the security of your login credentials
• You are responsible for all activity that occurs under your account
• You must notify us promptly of any unauthorized use of your account
• You may not create an account using another person's identity or impersonate anyone

User Content

Pouchd is a community platform. Ratings, reviews, comments, photos, profile details, and anything else you submit are "User Content." You retain ownership of your User Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that content within the App and its related features (such as the feed and leaderboard) for the purpose of operating and promoting the service.

You are solely responsible for your User Content and represent that you have the rights necessary to submit it and that it does not violate these Terms or any law.

Acceptable Use

You agree not to use the App to:

• Harass, threaten, bully, or harm other users
• Post content that is unlawful, hateful, obscene, defamatory, or infringing
• Impersonate any person or brand, or misrepresent your affiliation
• Promote, sell, or facilitate the sale of nicotine products or other goods
• Post spam, scams, or repetitive or misleading content
• Attempt to game the leaderboard, ratings, or stats through fake or automated activity
• Scrape, reverse engineer, or interfere with the App or its infrastructure
• Encourage nicotine use by minors or by non-users

We may remove content and suspend or terminate accounts that violate these rules, at our discretion.

Ratings and Reviews

Ratings, reviews, and flavor profiles on Pouchd are the personal opinions of individual users. They are user-generated and do not represent endorsements, medical claims, or factual statements by Pouchd. We do not verify the accuracy of any rating or review and are not responsible for User Content. Aggregated scores and recommendations are provided for community interest only.

Nicotine Product Disclaimer

Pouchd is a community platform for adults who already use nicotine pouches. It is not a retailer and does not sell nicotine products. Nothing in the App constitutes medical, health, or cessation advice. Nicotine is an addictive chemical. Nicotine products are intended for adult consumers only. Consult a healthcare professional with any questions about nicotine use.

Intellectual Property

The App, including its name, logo, design, features, and software, is owned by Pouchd and protected by intellectual property laws. These Terms do not grant you any right to use our branding without prior written permission. Product names and brand marks referenced in the App belong to their respective owners and are used for identification only.

Termination

You may stop using the App and delete your account at any time by contacting us at pouchdllc@gmail.com. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or if we discontinue the service. Sections of these Terms that by their nature should survive termination will continue to apply.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any content is accurate or reliable.

Limitation of Liability

To the fullest extent permitted by law, Pouchd and Nicholas Morin will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the App. Our total liability for any claim relating to the App will not exceed one hundred U.S. dollars ($100).

Indemnification

You agree to indemnify and hold harmless Pouchd and Nicholas Morin from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of West Virginia, United States, without regard to its conflict of laws principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in West Virginia.

Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the Last Updated date at the top of this page. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
